Planning Board Review Procedure

The following is a brief presentation of the steps an applicant can follow to file an application for a review by the Planning Board in the Town of Wilton.

This presentation has been made available to applicants for general informational purposes only and does not purport to include every requirement or regulation which may be required by the Wilton Town Code or State and Federal Laws.  The requirements applicable to your project will vary according to the details of the proposed project.

Pre-Application Conference

  • The owner/representative shall present project design information so that the Planning Board and the Director of Planning and Engineering can determine the feasibility of project before owner has invested a substantial amount of money.

Application Process

Conceptual Submission

Review applications and submission documents must be filed with Planning Board secretary by NOON, fifteen (15) days before Planning Board Meeting, which is held every 3rd Wednesday at 6:30 PM in Town Hall.  NOTE: It is the applicant’s responsibility to see that submissions are complete and filed on time (See the guidelines and checklist page of the review application for submission requirements).

After Submission:

  • The application and submitted documents will be reviewed Building Code Enforcement Officer and a Determination will be made as to the project’s conformance with the Town’s Zoning Code.
    • If a variance or special permit is needed, an application to the Zoning Board of Appeals must be in by the Tuesday two weeks prior to the ZBA meeting. The ZBA meets every 4th Thursday. The deadline for submission is NOON of that Tuesday.)
  • The application will also be reviewed by the Director of Planning and Engineering for completeness and whether a referral to the ZBA or Saratoga County needs to be made.

After Application Review:

  • If application is deemed complete, Planning Board secretary informs applicant of conceptual and review fees and places the project on the Planning Board Agenda, which is available the Friday before the meeting.
  • The Director of Planning and Engineering will prepare a conceptual review letter.
  • Public Service Agency Notification: Plans must be submitted to public service agencies by Certified Mail, Return Receipt Requested.
  • At time of Planning Board Meeting, conceptual approval by Planning Board can be made with or without conditions. Preliminary submission to Planning Department is next and due 15 days prior to meeting.

Preliminary Submission

Submissions will not be accepted unless all conditions of conceptual approval are met.
 
  • Director of Planning and Engineering will prepare preliminary review letter.
  • Preliminary application and engineering review fees will be due.
  • At next Planning Board meeting, Director of Planning and Engineering will declare whether preliminary application is deemed complete, and Planning Board Chairman can set date and time for Public Hearing.

Public Hearing

All adjacent landowners must be notified of public hearing no later than 10 days before hearing.

  • Public notice will be advertised in local newspapers.
  • Applicant can present preliminary submission.
  • SEQRA EAF form will be reviewed by Planning Board.

Final Submission

All town and reviewing agencies comments should be addressed; all conceptual and preliminary checklists completed and final language for deed restrictions, or easements submitted.

  • Upon final approval by Planning Board, applicant can submit a final checkset and upon approval by Director of Planning and Engineering, final mylars can be prepared.
  • Upon payment of remaining fees, mylars can be signed by Planning Board Chairman. 

Building Permit

Can be applied for after all fees are paid and mylars are signed.

  • Building department fees are separate and must be paid before permit can be issued.
